Dominique Bartholet
Dominique is a Fluent Spanish speaking attorney offering services in mediation, arbitration, neutral case evaluation, moderated settlement conferences and alternative dispute resolution. She is a Credentialed Advanced Mediator by the Texas Mediator Credentialing Association.
Dominique is a native of Colombia, South America and is fluent in Spanish. She is able to conduct full mediations in Spanish if needed. She possesses the ability to communicate with all the parties and discuss all aspects of the mediation process fluently in Spanish. Dominique has an awareness of cultural diversity and knows that it is an important tool for a mediator in helping the parties feel comfortable during mediation, to trust the process and work towards resolution. Dominique offers professional mediation and alternative dispute resolution services to both companies and individuals. Her fluency in the Spanish language and her excellent communication skills, help Dominique to effectively communicate with all parties involved in the case.
Her Scope of practice includes but is not limited to the following: personal injury – including all accidents, 18-wheeler accidents, commercial accidents, multiparty accidents, wrongful death, products liability, premises/slip and fall medical-malpractice, as well as contracts, commercial business, real estate and property, landlord/tenant, insurance, storm related damage, property disputes, and construction disputes.
Prior to founding her full-time mediation practice, Dominique was a civil trial attorney for over 20 years in Houston, Texas. Her areas of practice included commercial cases, 18-wheeler accidents, medical malpractice, wrongful death, products liability, premises/slip and fall accidents, automobile accidents and construction accidents. Dominique has extensive experience in personal injury litigation, ranging from the onset of the suit to resolution by mediation and arbitration as well as by jury trial and appeals. Throughout her career, Dominique has successfully resolved thousands of cases by way of mediation. As a result of her tenacity and never ending strive to resolve her cases, she was honored several years in a row with the”Best of The Bar” award in Texas.
Dominique knows and understands that Mediators not only need to use strong communication skills to understand a dispute and to connect to parties, but they also need to help the parties to engage in a constructive exchange when their own poor communication skills may be at the heart of the conflict. The fewer barriers to communication there are in a dialogue during mediation, the greater likelihood that the parties will get their points of view across effectively, understand each other, and work toward a mutually beneficial resolution of their case. In mediation, Dominique makes certain that the facts, issues and law are heard, analyzed, and followed logically. With excellent communications skills she is able to find creative, professional and innovative solutions acceptable to the parties in order to solve the disputes. She goes beyond simply trying to help both parties reach an agreement, but instead looks to discover new and innovative ways to satisfy the needs of all parties to the dispute while helping to maintain the parties’ working relationship. In nearly all mediations she has held, the parties have been able to solve their disputes before moving forward with additional litigation and trial. Dominique brings her ability to speak multiple languages as well as her years of knowledge, experience and expertise to the mediation arena in an effort to assist all parties in the resolution of their conflict and to help them be the architects of their solution.
Dominique provides mediation services in a convenient and confidential setting conducting mediations in-person at a convenient location in Houston, Texas, as well as via Zoom.

What Is A Mediator's Role?
For a mediation to be effective, the mediator’s role and general demeanor are absolutely essential. The following are the four main responsibilities that the mediator must fulfill in the course of their work:
– The mediator works to establish, sustain, and enhance dialogue between the parties to the dispute.
– The mediator improves communication between and among the parties to a dispute.
– To build trust and confidence between the disputing parties, the mediator must “befriend” them during the mediation process.
– To promote “active mediation.” The ability to develop a willingness to engage in constructive negotiation is referred to as active mediation.
The mediator gives each party the authority to be in charge of comprehending their conflict and coming to a mutually satisfactory resolution. The mediator enters the ongoing interaction between the parties with the goal of changing the interpersonal dynamics of the conflict relationship by assisting the parties in using appropriate communication techniques to aid in the resolution of the disagreement.
The mediator uses impartial language to summarize the points that are crucial to each party and their advocate. If necessary, they then go through each subject in more detail one at a time. Basically, the mediator facilitates an engaging discussion between the disputing parties when necessary.
